(11) No.565 of the 22nd August about the appointment of

Megarry as Chairman of the Public Services Commission. Megarry has now given notice of resignation and will be leaving here next March.

We have been considering the question of his replacement. We have come to the conclusion that there is not nearly sufficient work to justify a full time appointment and the proposal now is that we should amend the Public Services Commission Ordinance so as to permit of a Judge of the Supreme Court being appointed as Chairman. To do this, we should have to increase the establishment of Puisne Judges by one and such an increase would be convenient because the Supreme Court does need some help though not as much as one additional Puisne full time.

We are all agreed here that there is no objection in principle, but we feel that we must clear the principle with Howe, the Chief Justice Designate, who is not due to arrive here until next February. I attach a copy of a letter which I have written to him on the subject. Assuming that Howe has no objection in principle, we will then approach you officially with the proposal. If there is an objection in principle to appointing a Judge as Chairman of the Public Services Commission, perhaps you would be good enough to let me know. We greatly hope that no objection in principle will be seen at your end because we cannot think of any other satisfactory solution to our problem.
